Bitebro – Terms and Conditions

1. Acceptance

These Terms of Use and any other terms and documents expressly incorporated herein (together, the "Terms of Use") apply to your use of the Bitebro website, Bitebro mobile application ("Bitebro App"), blog, or any other products or services offered by Bitebro Pty Ltd (ABN 41 690 701 994) (together, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms of Use. If you do not agree, you must not access or use the Platform.

2. Eligibility

a) By accessing or using the Platform, you confirm that you are of legal age in your country, are not under 16 years old, and have the power and authority to agree to these Terms of Use.

b) To use certain features, you may need to create a User Account by providing your name, email address, password, date of birth, and other information as required.

c) You are responsible for maintaining the security of your User Account and credentials. Bitebro is not responsible for any loss arising from unauthorised access caused by your failure to secure them. You must notify us at admin@bitebro.com if you suspect unauthorised use of your account.

d) Medical Disclaimer: Bitebro is an AI-driven food choice assistant designed to provide general nutrition guidance. It is not a substitute for personalised medical or dietary advice. You should consult a qualified health professional before making significant dietary or lifestyle changes.

3. Subscriptions and Payments

a) The Bitebro App is free to download and includes limited access to features. Additional use beyond free limits requires a paid subscription.

b) Subscriptions may be offered on a weekly, monthly, quarterly, or annual basis, or for other periods as available through the Bitebro website (www.bitebro.com) or applicable app stores.

c) Bitebro may revise subscription fees or package options at its discretion. Changes will apply prospectively to new subscriptions.

d) Free Trials: Bitebro may offer free trials (e.g., a limited period or a set number of free scans). Free trials are available only to new users unless otherwise stated. At the end of the trial, subscriptions automatically renew at the full price unless cancelled before the trial ends.

e) Payment methods include credit card, PayPal, Stripe, or app store billing. By submitting payment details, you confirm you are authorised to use them.

f) Subscriptions renew automatically unless cancelled at least 48 hours before the end of the current billing period. You may cancel at any time through the Bitebro website or relevant app store, but no refunds are provided for unused portions of the subscription term.

4. Refund and Cancellation Policy

a) If you subscribed through an app store, cancellations and refunds are governed by that store's terms.

b) If you subscribed via the Bitebro website, we do not offer refunds for change of mind, unused features, or failure to use the Platform.

c) Your statutory rights under Australian Consumer Law remain unaffected. Our services come with guarantees that cannot be excluded under law.

5. Referral Program (Customers)

a) All users receive a unique referral code. You may share this code to invite friends.

b) For each valid referral, you may earn points. Points have no cash value and can only be redeemed for rewards, giveaways, or perks as specified within the Platform.

c) Bitebro may run monthly giveaways or reward programs. Entries and rewards are earned based on app use and valid referrals.

d) Referral codes may not be sold, traded, or shared on coupon websites. Self-referrals, duplicate accounts, or fraudulent use of codes are prohibited.

e) Bitebro may revoke or suspend referral benefits at its sole discretion if abuse is detected.

6. Affiliate Program (Partners)

a) Certain approved users ("Affiliates") may join the Bitebro Partner Program. Affiliates can earn commissions based on subscription revenue generated by referred users.

b) Affiliates will receive unique referral codes or links, which can be used by multiple new users.

c) Commission is based on net revenue received by Bitebro, after fees, refunds, and chargebacks.

d) Payouts are made monthly in arrears, provided the Affiliate has supplied accurate payment and tax information.

e) Affiliates are responsible for declaring and paying any taxes on commissions they receive.

f) Bitebro reserves the right to approve, suspend, or terminate Affiliate accounts at its sole discretion.

7. Limitations

a) To the maximum extent permitted by law:

  • Bitebro's aggregate liability is limited to the subscription fees paid by you for the service giving rise to the claim.
  • Bitebro is not liable for indirect losses (profit, revenue, goodwill, opportunity, etc.).

b) Bitebro provides general nutrition guidance. We make no guarantees that use of the Platform will result in weight loss, muscle gain, or other health outcomes. Decisions about food intake remain your responsibility.

c) Bitebro is not liable for advice misapplied due to unclear or misleading images or incomplete information provided by you.

9. Use of the Platform

By using the Platform, you agree not to:

  • Upload offensive, irrelevant, or non-food images.
  • Use the Platform unlawfully or fraudulently.
  • Attempt to interfere with or reverse-engineer the Platform.
  • Share or transfer your account access.
  • Misrepresent or misuse Bitebro outputs (e.g., as medical advice).

10. Intellectual Property

All intellectual property rights in the Bitebro Platform, including software, branding, and content, belong to Bitebro Pty Ltd (ABN 41 690 701 994) or its licensors.

11. Changes and Updates

Bitebro may modify or discontinue features at any time. Updated Terms of Use will be published on the Platform. Your continued use constitutes acceptance of the revised Terms.

12. Availability of Service

We will use reasonable efforts to keep the Platform available but do not guarantee uninterrupted access.

13. General

Disputes: Parties must attempt informal resolution before commencing court proceedings (except urgent relief).

Relationship: These Terms do not create an agency, partnership, or joint venture.

Marketing: If you share photos or tag Bitebro on social media, you consent to their use for promotional purposes.

Governing Law: These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of Queensland courts.
